Case "Resource Analysis of a Legal Conflict"
Situation "Museum"
Information for Julia
You have been working at the museum for about 10 years. This is your first and only place of work. When you came to work here, there were 3 people on staff, and these three people "carried" on themselves everything that was possible. We had to conduct 6-7 excursions a day, since there were no tour guides on staff, and all the excursions were conducted by you and the museum director. The museum developed, new employees appeared, but no one knew the museum exposition and museum funds as well as you. All the museum projects are your projects, all the long-term development programs are your programs. Two years ago, the regional government allocated a large sum of money for a major overhaul of the museum and the creation of a new exposition.
The old exposition was dismantled, the floors were opened, the walls were broken down. And then suddenly the director, with whom you worked all these years, resigned of his own free will. And the creation of a new exhibition becomes your problem, because the Ministry appoints you as acting director (who else?).
The renovation was completed on time. The new exhibition turned out to be gorgeous, the opening was pompous. You were extremely proud of yourself. And then a new director is appointed to the museum. Not only is he not a museum specialist, has never worked a day in any museum (even a rural one), he is not a philologist or a cultural scientist, naturally, he cannot tell you anything about the exhibition. So he also “brought” three people, the same “specialists”.
You cannot work with him: he understands only pipes and building materials, although he is most likely a candidate of science, and a candidate of sciences as well. The most unpleasant thing is that he is constantly “clinging”: he keeps trying to find out what the funds department is doing, what cards it is filling out, endlessly demands some documents, either about linoleum, or about the website - who made it and why so much money was paid. At the same time, “his people” feel quite at ease in the museum. They go to the gym during the workday, don´t go on excursions, and don´t even plan to.
The last straw that broke the camel´s back was the fact that the new director assigned salary increases without consulting you. How is this possible if he doesn´t realize the amount of work that employees do? You think he should leave of his own accord. And since he himself doesn´t understand that he´s in the wrong place, he needs help with this. Moreover, he hired his wife as chief accountant. You laid all this out in a letter and sent it to the Ministry.
The director was called "on the carpet", and after that he decided to take revenge on you. He said so openly in front of everyone: "Maybe they´ll fire me, but first I´ll fire you." Now he´s throwing at you tasks that were initially impossible to accomplish. He´s already issued two reprimands. The last reprimand was for absenteeism. You gave an interview on television, and you weren´t at work from 10 a.m. until 2 p.m. The director wrote in the order to issue a reprimand that there was absenteeism. You have appealed everywhere: to the State Labor Inspectorate, to the prosecutor´s office, but they still can´t fire the hated director, and you have no peace either.
Information for the caucus
In fact, the documents left after the renovation are a mess. You don´t understand construction, they just brought you all sorts of acts and estimates, and you signed them without looking. You are afraid that he will "dig" under you and "dig up" something (this is confidential information).
You have nothing against him personally, you just think it is unfair that they did not appoint you as director, because you would have been the best candidate. And if they did not appoint you, then they should have brought back the old director, especially since he himself contacted the Ministry with such a request.
